On April 8, 2010, Andrew Lustigman will Speak at the American Bar Association's 25th Annual Intellectual Property Law Conference: "Texting, Toggling, Tagging, Tweeting: Copyright, Trademark and Advertising in New Media" in Arlington, VA .

Online and social media are increasingly popular with marketers who want to take advantage of new technology, viral marketing and word of mouth exposure. As these new marketing channels are exploited, new legal concerns arise both from copyright and trademark perspectives.This program will include demonstrations of new technologies and discussion of their impact on copyright law, while also considering the unauthorized use of trademarks on social media sites.

This telephonic update will summarize the significant developments in consumer protection law that occurred in January 2010. The presentation will cover cases, settlements, and other initiatives at the federal and state levels, as well as consumer class actions, Lanham Act litigation, and National Advertising Division case decisions.

This program is a monthly series of updates provided by the Consumer Protection Committee in which individuals can call in and hear consumer protection practitioners report on the previous month's developments. On December 1, 2009, the FTC's newly revised Guides Concerning the Use of Endorsements and Testimonials in Advertising (http://www.ftc.gov/opa/2009/10/endorest.shtm) went into effect. The Guides modify the existing obligations of advertisers regarding endorsements and testimonials, and also add new obligations specifically for online commenters about products.

With the onslaught of environmentally-friendly companies, products, and advertising claims comes scrutiny by regulators and others regarding the accuracy and properly qualified nature of such claims. This CLE provides attorneys and marketers with the legal tools needed to address legal compliance obligations associated with making "green" or environmentally friendly claims in advertising and marketing programs. The presentation breaks down the components of environmental marketing law compliance obligations by examining the integral components of the Federal Trade Commission Act, NAD Decisions, and state law. Scott Shaffer Presentation on Negotiation of Sport Endorsement and Sponsorship Arrangements

On March 11, 2009, Scott Shaffer participated as a panel member on a presentation concerning the negotiation of endorsements and sponsorship deals in professional sports. The legal forum was held at the New York County Lawyer's Association in downtown Manhattan. Scott's presentation focused on recent trends in morals clauses and what advice to offer professional athletes when entering into endorsement contracts. Besides Scott, the other featured speakers were Elizabeth Durkin of the law firm Durkin & Durkin; Christopher Chase of Frankfurt, Kurnit, Klein & Selz; and Keven Davis of Garvey Schubert & Barer. The moderator was Paul Stuart Haberman of Heidell, Pittoni, Murphy & Bach.
